1. Applications for pensions under the Community Social Security Regulations (RRCC) must be submitted to the competent institution of the country of residence of the person concerned, which in Spain is the General Directorate for Social Security Planning, when it concerns pensions caused by officials of the State Passive Class System.
When the person concerned successively accredits periods of service in the State System of Passive Classes and contributions to the Social Security System, the competence shall lie with the body or management entity - the National Social Security Institute - to which the last contributions have been made. If the latter contributions are simultaneous, the institution responsible for processing and resolving the pension in application of Community regulations will be the National Social Security Institute (INSS).
The request for the application of Community regulations means that the pensions that may be payable under all the laws of the States in which contribution or insurance periods are credited will be recognised and settled.Nor, however, the request for a pension from one of the countries may be deferred by reference to paragraph 7 of the request for a retirement pension and paragraph 8 of the request for a disability pension.
2.Requests for information on periods of insurance in other States shall be submitted to the competent institution of the country of residence using the model for that purpose. Through this procedure, the pension institution of the country of residence will liaise with the State(s) in which the person concerned alleges that he/she has performed work activity/residence and will request the form relating to his/her insurance career.
