Extraordinary Pensions

Causative Fact

It is retirement or retirement due to permanent incapacity/futility for service or the death of the staff member, provided that such incapacity/futility or death is caused by accident, illness, in act of service or as a result thereof.

The act of service shall be presumed, unless evidence to the contrary exists, where the staff member ' s permanent incapacity/uselessness or death occurred at the place and time of work.

Calculation of the pension

  • Retirement or retirement

The extraordinary retirement or retirement pension is calculated by applying, at 200 per 100 of the regulatory entity concerned, the corresponding percentage according to years of service provided, with the particularity that the full years remaining for the official to reach the age of retirement or forced retirement shall be considered as effective services, in addition to those accredited up to that time, and shall be deemed to have been provided in the Corps, Scale, place or employment to which the person responsible was assigned at the time of the declaration of retirement or retirement.

This type of benefit is calculated in accordance with the criteria set out above for ordinary pensions, although the regulatory basis shall be set at 200 per 100 and the full years remaining for the staff member to reach the age of retirement or forced retirement shall be considered as effective services for the State, in addition to those accredited up to that time, as provided in the Corps, Scale, place of employment or category to which he or she was attached at the time of death.
