1.- Causes
The deceased, declared deceased, or disappeared during or after the civil war, provided that a personal and direct causal relationship can be established between the civil war and the deceased ' s death, as well as those who have caused a pension for their death due to war events prior to 1936.
2.- Beneficiaries
The widowed spouse and, in his absence, the orphans under 21 years of age or over, incapacitated for any work from before the age of 23 or the death of the deceased, and the parents of the deceased, provided that they meet the conditions required by the general legislation on passive classes applicable in each case.
3.- Amount of pensions
(A) If the perpetrator was professional of the Armed Forces and Public Order:
Widows ' and orphans ' pensions for incapacitated children and for parents are 200 per 100 of the regulatory basis that would apply to the deceased, depending on the graduation and years of service that he or she had accredited at the time of his or her death.
The orphan ' s pension for non-disabled adults is 100 per cent of the regulatory basis described in the preceding paragraph.
(B) If the deceased was not professional of the Armed Forces and Public Order:
Since 1 January 1996, the State ' s General Budget Acts have established the same amount of these pensions as the minimum Social Security widow ' s pension for persons over 65 years of age, which in 2025 is 874.40 €/month.
Since 1 January 2008, orphan ' s pensions for non-disabled orphans (which have not been updated since 1981) have been revalued at the same percentage as other public pensions. In 2025, the amount is fixed at 194.26 €/month.
