Community Regulations and Bilateral Social Security Conventions

Since 25-10-1998, the Special Schemes for Public Officials in Spain have been included in the scope of the European Union regulations for the coordination of social security systems.

Regulation 883/2004 on the coordination of social security systems and Regulation 987/2009 on the implementation of the Regulation on coordination are currently in force.

The Passive Class System is included in the bilateral social security agreements with Japan and Senegal.

COORDINATION OF SOCIAL SECURITY SYSTEMS IN THE EUROPEAN UNION

In the field of public pensions, this inclusion allows the periods of contributions and the like covered under the regulatory legislation of other Member States of the European Union or of the European Economic Area or Switzerland or of the United Kingdom of Great Britain and Northern Ireland to take effect both for the recognition of the right and for the calculation of pensions, which may be caused in the State Passive Class Scheme.

INTERNATIONAL SOCIAL SECURITY CONVENTIONS APPLICABLE IN PASSIVE CLASSES

In application of the Bilateral Social Security Agreements between Spain and Japan and between Spain and Senegal, the periods of insurance completed under the legislation of these countries will be taken into account for the acquisition of the right and determination of the pensions of the Passive Class Scheme included in its scope. To this end, an express request must be made to take these periods into consideration by submitting the relevant request.
